Apple's stance to date has been that they want one model to work everywhere, hence using the GSM Standard. Seeing as how CDMA is being basically abandoned with most major Carriers adopting LTE for their next-gen networks I would not expect to see a CDMA iPhone. I have not doubt that the AT&T Exclusivity will end, though I do not know how it will happen, seeing as T-Mobile uses a different frequency for 3G service.

That AT&T exclusive contract NEEDS to end.  AT&T is an asshole company for mobile.   I was with them when they were "cingular" - and they SUCKED DICK.  

Worst service I ever had.  Everything from voice, quality, support, billing - everything was pure shit.  Then I canceled my contract on the DAY it ended, the motherfuckers tried to charge me the cancellation fee (and jacked it up to $500)!   Fucking bastards.

Then after the fact - they send a collections letter trying to "settle" $500 for $25 ( Translation:  a trick in order to get me to mail them a payment to reset the statute of limitations - then say it's an error.   You pay $0.01 to a statute bill, you reset the clock. )

Motherfuckers.

The exclusive contract wont end in the US unless ATT cant meet sales numbers on them more likely then not.

And the day your contract ends IE if the contract ends 04/26/2010 and you cancel 04/26/2010 then you canceled when it was still in effect. If you canceled on 04/27/2010 the its no longer valid, unless they put a time on the contract as well. But you get the point.

They are a massive fucking company and its not a guy in a office that says hey he canceled the last day of the contract. Its in the computer and its supposed to be like that. Cancelation fees were all listed in the contract you signed. If you didnt like you contract you shouldnt have signed it to begin with. You cant blame ATT for fucking you in the ass when they say in the contract they are going to do it if you do XYZ

who cares? apple has every right to do this. Its an unreleased product that may have been stolen and then sold to the press as a possibly incomplete item. They called the cops reported the item stolen, describe it and then when the bullshit pops up on the internet at they call the cops again and say HEY THAT PHONE IS THE ONE THAT WAS STOLEN. wtf do you think happens?

That's the problem though.

If I decided to release a brand new computer, with a bigger hard drive, a camera, a better network card, a bigger screen, and a slightly differently shaped case ...

It's an improved version of the same exact thing that they released a couple years ago.  With a bit of improvement.   It's no big secret.   It's the same old iphone with different parts.  

Who is going to be surprised?   "GASP!  I heard they're improving the capabilities!"  "GASP!  I hear it's going to have a larger storage capacity!"   "GASP!  I hear it's going to have a SD-Micro slot!"

Is this trade secret?   No.  Not really.

I see nothing to be fantastically excited about.   Man ... if the guy were still alive, I'd love to e-mail my old technology ethics professor.   He was a JD attorney whose undergrad degree was Comp Sci.  [ Guy died of a heart attack.  He was one of my youngest professors too - barely over 40.... ]

I bet that guy would know the answer to this whole shithole.  

( Based on the facts presented here, IMO, Apple loses - and I'm looking from the standpoint I just took above.   I suppose eventually, we'll see someone else's [read: a judge's] opinion on it to see how this stands under the law.  There is nothing truly novel about this new improved iPhone, and it's no secret at all - with tens of millions of them on the market.   What comes next, put a blue line instead of a silver line on it - and then it's a new trade secret model that warrants prosecution if stolen or revealed? )

Now on the OTHER hand - if this had been the iPad which were leaked and released - THEN - I would say Apple has a rock-solid unarguable case of stolen trade secret.

[ BTW - On a side note, where do you think prosecuting something like this will lead?   IMO wikileaks is a criminal organization which should be shut down.  Yeah.  You got it.  Apple IS Big Brother doing something like this.   If Apple gets a positive ruling on the people who released their crap - what do you think the can of worms will look like ... after it's been opened? ]

apples actions are dick, but perfectly just. Be it just an improved version of the old version or not its still a technically new model. A prototype for it is owned by apple. And is stolen either intentionally or by mistake. You cant blame apple for this you can call gizmodo fucking stupid though

i guess you guys forgot about what apple did with the first gen iPhones... when people put non Apple approves Apps on them they would remotely kill you phone, then they setup up the app store... but they killed like 100k phones and they kept it out of the big news outlets

to the guys talking about wanting the iPhone AT&T only to end, you might have to wait longer then you think... its not AT&T holding onto it, Apple wanted verizon to carry the iPhone and they told them to suck it and picked up the droid


Apple wants too much control over what people can and cannot do with their iPhone, it a major turn off to companies when everything has to be done the way Apple says so... with the Android OS being open source consumers can make apps the way they want them, not wait for apple to make some half assed thats close

The phone had been returned by the time the raid took place so your argument is meaningless.  And since there was no evidence that the phone was stolen rather than lost, the "receipt of stolen property" justification is bullshit as well.

The point of the raid was to obtain information regarding who sold them the phone, and which apple employees have leaked information in the past.  Neither of which are remotely just, and both of which are highly illegal.  I hope Chen files armed robbery charges against whomever approved the raid.

Actually it is new. Every iPhone to date has used off the shelf ARM Processors from Samsung. This is the first iPhone to include a Apple in-house Designed CPU and I would imagine thats what they were so worried about getting out.
