It is going strong as pvp multiplayer, not as an MMO which was the original idea.
To your second question, most respectable game developers make their own game engines to meet the demands for their MMO (World of Warcraft and Guild wars are excellent examples).

if this is poised as a diablo 2 style game then it should be pvp heavy also which unreal engine will hurt less

Indeed, just naturally sceptical about Unreal Engine being used in anything other than shooters.

They had plans for big warzones and all that, afterwards they admitted that those plans could not be fulfilled because of the limitation of the Unreal Engine. The biggest thing they managed to pull off are those defence raids. That is what I was referring to. If you think that good old pvp matches are "repetitive trash", that is your problem, because that kind of "repetitive trash" proved to be very successful from the old days of CS, Quake and UT games and lives on in BF3, GA, CoD, etc...

So you don't the desert zone was boring as hell?
I cba to grind just so I can pvp, which is the main draw of this game. If I wanted to grind I'd go play Aion or something.

You don't, you can start pvp from a very low level. Also by the time they released the first desert zone, all 4 of my classes have been lvl 50 for a while.
