Fuck no.

I have no caps and I live in Canada. Even if I had a residential connections I would not have a cap. On bell aliant ToS is says normal use should be below 250GB per month. But do not mention what is a limit that they would contact you or cut your connection. And no one has ever lost their connection due to downloading a fuckload.

What's your ISP, bell doesn't offer me unlimited...  only 60gbs

Ah, I'm on teksavvy Toronto.

Is it normal for my cable speeds to vary?  Around 3am I'm getting 30mpbs but around 5-9 I'm only getting 8

Sounds like they are fucking with your speeds. IE traffic shaping.
Give this tool a try http://www.measurementlab.net/measurement-lab-tools#tool5 "ShaperProbe traffic shaping test"
See what it gives you for a result. Can also try their other test for app specific shaping.

I never had a problem with Bell Aliant or Rogers with limiting my speeds at a time of day. I could download none stop for days on end and speed would be constant.

What speeds are you paying for?
